NY COURT DECISION DISMISSES CASE BROUGHT BY FAMILY OF ARI FULD Z”L AGAINST THE PLO  Ruling Endangers Other US Litigation Brought By Victims Against Palestinians  In 2004, 11 American families brought suit against the Palestinian Authority and PLO in the New York federal court over their Intifada terrorist violence. The lawsuit on behalf of the families who had lost loved ones and had been injured in Palestinian attacks perpetrated in Israel, captioned  Sokolow v. Palestinian Authority, alleged that defendants were responsible to them for their bombings and shootings that resulted in injuries under the US Anti Terrorism Act (ATA). It took 11 years, but after a seven week long trial in Manhattan, on February 23,  2015, an anonymous jury found the PA and PLO were liable on all counts and awarded the plaintiffs with a $615,000,000 judgment.  Several other lawsuits similarly alleging liability against these defendants for their terrorist attacks were still being litigated.   After the trial, the Palestinians appealed the Sokolow decision.  Their chief argument was that they were not present in the United States and the terrorist attacks had not specifically targeted Americans but rather Israelis. The Second Circuit Court of Appeals agreed with them and ruled that the sections of the ATA which imposed personal jurisdiction on these foreign terrorist organizations simply because they killed and injured US citizens was unconstitutional. The Court found that the  fact that the Palestinians had a single office in Washington, DC, was insufficient to establish they were present in the US for purposes of legal jurisdiction. In April 2018, the US Supreme Court upheld the Second Circuit’s decision, nullifying the Sokolow verdict.  Israeli policemen search the scene of a suicide bombing in central Jerusalem on January 27, 2002. After having their lawsuits and jury award canceled, the families lobbied the Congress and Senate and succeeded in having the law amended. In 2019, Congress responded to these rulings depriving American citizens the opportunity to sue the Palestinians in US courts by enacting the Promoting Security and Justice for Victims of Terrorism Act (“PSJVTA”). Under the new PSJVTA, terror groups like the PA and PLO can be held to have personal jurisdiction imposed upon them and haled into American courts for their overseas violence. The new law would amend the definition of “defendant” to specifically include the PA and the PLO. It also provided two new factual predicates for conduct that will be “deemed” consent to personal jurisdiction for civil actions under the ATA:  As amended by the PSJVTA, the ATA now provides that a defendant “shall be deemed to have consented to personal jurisdiction” if, after April 18, 2020, it “makes any payment to either (i) a payee designated by someone imprisoned for an act of terrorism that injured or killed an American national “if such payment is made by reason of such imprisonment” or (ii) to a family member of an individual who died while committing an act of terrorism that injured or killed an American national “if such payment is made by reason of the death of such individual.”  The law states that a defendant will be “deemed to have consented to personal jurisdiction” if, after January 4, 2020, it “establishes,” “procures,” or “continues to maintain any office or headquarters, in the United States,” or “conducts any activity while physically present in the United States on behalf of” the PLO or the PA. The law assumes that because the Palestinian groups were given fair warning and were on notice that their actions would constitute consent to the jurisdiction of U.S. courts, their due process rights were not violated  and they can be tried in an American court.  Armed with the  PSJVTA, the Sokolow plaintiffs filed a new motion to have their prior judgment against the Palestinians reinstated. They are optimistically awaiting the district court’s decision on their petition. Recently however, a new ruling has complicated the matter.    On September 16, 2018, an American citizen, Ari Fuld z”l was brutally stabbed to death by a Palestinian terrorist in Gush Etzion, near the city of Efrat in Israel. The Fuld family brought suit against the PA and PLO contending that its “slay to pay” policy which provides monthly stipends to the families of imprisoned terrorists and suicide bombers created an inducement which encouraged Palestinian terror against Jews and Israelis. The family’s civil action, Fuld v. PLO, alleged that the PA was therefore responsible for aiding and abetting the murder of Ari Fuld under the amended ATA.   Ari Fuld z”l murdered on September 16, 2018 The District Court in the Fuld case has just issued a troublesome decision. Judge Jesse Furman has ruled that the language of the new statute, the PSJVTA, is also unconstitutional  He has held that Congress in enacting the PSJVTA has overreached in imposing personal jurisdiction on the Palestinians. “The federal courts cannot exercise jurisdiction in a civil case beyond the limits prescribed by the due process clause of the Constitution, no matter how horrendous the underlying attacks or morally compelling the plaintiffs’ claims.”  The Court held that exercising jurisdiction in the Fuld case would go beyond the limits prescribed by the Constitution’s Due Process Clause, unfairly targeting the terrorist Palestinian organizations, and unconstitutionally imposing liability upon them.  The Court concluded that Palestinians’ motion to dismiss for lack of personal jurisdiction would be granted and rejected the Fuld case. This is a dangerous ruling that could affect the other cases, including the Sokolow’s, being litigated against the PA and PLO.  The Fuld lawyers have filed an appeal and the families of the other victims with cases pending against the Palestinians are awaiting their own courts’ rulings on this threshold matter. In these extraordinary times we are compelled to step out of our comfort zone and rethink many things we always took for granted. Many of the leaders and institutions we always supported, and which we believed were fundamentally on our side, are taking off their masks. It behooves us to see them for what they are, and not serve as their apologists.

Chazal taught us long ago that before the arrival of Moshiach the leaders would be mostly Erev Rav – essentially, moles working to destroy us from within. This teaching should give us strength when so much of the rabbinic establishment has prostituted itself and issued wayward proclamations. This was foretold. We’re finally there.

It should also give us the confidence to stand up to shady characters, even if they are impressive scholars with long beards and a regal appearance. Rotten people can study Torah and dress in rabbinic garb, just like anyone else. We must see past the fancy exterior. It’s our responsibility to recognize the Erev Rav, expose them, and banish them from our midst.

Aafia Siddiqui is a Pakistani neuroscientist currently serving 86 years for the attempted murder of American troops and FBI agents.

A man on Saturday took multiple hostages at the Beth Israel Synagogue in Colleyville, Texas, demanding the release of Aafia Siddiqui, who is currently serving an 86-year prison sentence for the attempted murder of American troops and FBI agents who arrested her.

Although initial reports suggested the hostage taker was Siddiqui’s brother, a former lawyer of the brother claimed that he was not involved in the hostage situation, according to The Daily Beast news site. Upon hearing about the incident, Siddiqui released a statement telling the hostage taker to stand down, it reported.
