(Nov. 20, 2021) — On September 16, the Public Health and Medical Professionals for Transparency (PHMPT) filed suit against the U.S. Food & Drug Administration (FDA) for its failure to release documentation sought under a Freedom of Information Act (FOIA) filed in August pertaining to its “approval” of a COVID-19 vaccine.
The documents pertain to the agency’s August 23, 2021 approval of a Biologics License Application (BLA) for the “Comirnaty” COVID-19 vaccine manufactured jointly by Pfizer and BioNTech.
The FOIA request had sought “All data and information for the Pfizer Vaccine enumerated in 21 C.F.R. § 601.51(e)1 with the exception of publicly available reports on the Vaccine Adverse Events Reporting System.” The system’s acronym is VAERS, whose data on reported side effects of vaccines are released each Friday current to the previous Friday.

Although lofty, this is still a lower number than the estimate offered by the CDC director on Twitter of 80%. Interestingly, in the only published cluster RCT to date during COVID-19, surgical masks had an 11% risk reduction and cloth masks had no effect at all on the primary endpoint of symptom driven lab positive results. That cluster RCT took place in a location with essentially no vaccination (aka circumstances which would give masks the best chance to show the best effect size).
