This week, Channel 11’s journalist Ayala Hasson broadcast a two-part exposé on the Israel Defense Forces’ self-investigation of the massacre at the Nova music festival on Oct. 7, which took place a kilometer from the Gaza Strip. Hasson’s reports reinforced the fact that the IDF and Shin Bet top brass are to blame for Hamas’s successful day of genocide.
A total of 364 people were brutally murdered at the Nova music festival and along avenues of escape. Thirty-nine were taken hostage. The rave opened on Oct. 5 with 3,800 revelers.
According to earlier investigative reports, the IDF intercepted Hamas’s invasion plans a year before Oct. 7. They received multiple, rapidly escalating warnings of the impending invasion from a variety of sources in the Southern Command in the months, weeks and days prior to that day. Intelligence head Maj. Gen. Aharon Haliva, IDF Chief of Staff Lt. Gen. Herzi Halevi and Shin Bet director Ronen Bar did not share the warnings or Hamas’s intercepted invasion plans with Prime Minister Benjamin Netanyahu. Instead, they repeatedly briefed him that Hamas was deterred, and Israel simply needed to provide it with more cash from Qatar and more work permits for Gazans in Israel to keep the terrorist regime fat, happy and deterred.
On Oct. 10, we learned that on the night between Oct. 6 and Oct. 7, Halevi, Bar, Southern Command Chief Maj. General Yaron Finkleman, Operations Directorate Chief Maj. Gen. Oded Basiuk and Haliva’s assistant (Haliva was on vacation and not answering his phone), held two telephone consultations, at midnight and 4 a.m., when they discussed multiplying indications that Hamas was about to carry out its invasion, slaughter and kidnapping plan. They chose to do nothing, told no one and agreed to meet again at 8 a.m. Hamas invaded at 6:30. [Emphasis added]

He has made several such declarations since taking office and claims that they are intended to strengthen Israeli presence in those areas. What is the process, and how will it help?
Background
All three areas are currently administered under a combination of laws derived from the Ottoman, British, Jordanian, and Israeli military and civil legal systems. This, combined with the incomplete state of land registries under some of these governments and the confusion caused during Israel’s many wars, has left the status of a significant portion of land in doubt.
In the years following the Six Day War, Israel suspended a British system to register new titles for the land in these areas. Initially, Israel declared that all land taken in the Six Day War would be assumed to be captured assets of the Jordanian government, and would be transferred to the control of the IDF’s emerging military government of the region. These included land that Jews had controlled until Israel’s War of Independence, at which point they were captured by Jordan and transferred to the custodianship of a Jordanian officer appointed to manage enemy assets.
The IDF’s policy of distributing land by military order continued until 1979 when the seizure of two Arab villages to build Elon Moreh sparked a Supreme Court case that ultimately required the state to create an alternative and forbade the use of military orders to seize land. Israel began instead drawing on an Ottoman land code stating that land that had remained fallow for a set period became the property of the empire.
A stringent interpretation of this code became the basis for claiming that the land belonged to the state of Israel rather than to a private owner or local authority. Similarly, it was the impetus for Israel to begin rejecting local registries of the land as proof of ownership, such as the recognition of village chieftains (mukhtars) or local tax registries. This meant that land that was not registered already under the British system would be available to transfer to the state.
This Ottoman policy has also become the basis for the use of the term ‘declaration’ in Israel. As international law prohibits the seizure of private land, Israel claims that the land is not being seized; rather, the extant law turns it over to the state, which merely announces that the change in ownership has occurred.
As part of the Oslo Accords, the Palestinian Authority was given the responsibility for registering land in the newly-defined Areas A and B. Dmage to PA buildings and the loss of personnel during the Intifadas have impinged its ability to do so. The accuracy of its registries remains a matter of dispute.
In an attempt to abide by an international law forbidding an occupier from seizing private property, Israel refrains from seizing privately owned Palestinian land. There have even been cases where it demolished towns built on Palestinian land, such as that of Amona.
Process
The Civil Administration represents the Israel Land Authority in the region and is responsible for processing requests to declare state land via the Supervisor of Governmental and Abandoned Property in Judea and Samaria. Although the process is an internal one, it generally includes the state presenting the Supervisor with a map of the parcel to be declared, following which a warning is sent to the chieftains of communities within the parcel. The communities generally have 45 days in which to appeal the claim before Israel acquires the land and can legally redistribute it.
Minister Smotrich’s titles include those of a minister within the defense ministry, and among the sections of the ministry under his control as opposed to that of the Defense Minister has been the Civil Administration, making such declarations ultimately his purview.
This process differs from that of recognition of new townships, as happened in the case of Evyatar. Although the land in Evyatar was declared state land, the legitimization of a town falls under the Interior Ministry, not the Defense Ministry.
Implications
Once land is declared state land, it can be rezoned by the government. Due to a military order regarding the governance of the region, it cannot be sold to private individuals, so the government instead allocates it to either corporations or local authorities for the development of new towns or the extension of existing ones. These companies include Amana, recently sanctioned by the USA for its part in such activities.
The most recent parcel has been divided among several towns, in some cases nearly doubling the land available for Israeli use. It has been hailed as a gift to Israeli development of Judea, Samaria, and the Jordan Valley, and Minister Smotrich has stated that he intends to continue the process as part of his efforts against the establishment of a Palestinian state.

Shipment of heaters unable to reach soldiers in time
Unexpected glitches prevent soldiers in Israel’s North from receiving heating.
Dec 5, 2024, 8:33 PM Israel National News – A shipment of heaters intended for army tents in Northern Israel is currently on hold. Temperatures across the northern border are dropping, with soldiers battling biting winds and freezing nights. The plan to send 100 heaters to help soldiers combat the heat has been put on pause after funding ran dry.
When organizers saw that they wouldn’t be able to get the heaters to soldiers before December, they were devastated. These heaters would be deal-breakers for soldiers sleeping in unprotected army tents, providing them with toasty warm nights.
The campaign relies exclusively on public donations, and organizers hope funding will pick up again, enabling the soldiers to receive much-needed heaters. The heaters were chosen to tailor to soldiers’ needs, with each heater capable of heating a standard 6-soldier tent and being charged at the base before the soldiers entered the field.

Over a year after 10/7: IDF to provide weapons to all female observers Yoni Kempinski
The decision follows criticism that female observers were left defenseless when their bases were invaded on October 7.
Dec 5, 2024, 7:01 PM (GMT+2) Israel National News – The IDF has decided based on the lessons of the October 7 Hamas attack that every female observer will now carry a personal Tavor-type firearm upon the completion of her training.
The army’s decision, which will be implemented within a month and a half, comes in light of criticism that female observers were left defenseless in the face of the Hamas terrorists who broke into IDF bases on the day of the massacre, without any ability to protect themselves and their comrades because they did not have the weapons with which to do so.
In addition to the criticism about the failure to provide weapons to female soldiers, female observers have testified that they had repeatedly warned of unusual activity by Hamas terrorists before the massacre but their warnings went unheeded.
In addition to the decision to provide weapons to the female observers, the IDF emphasized that in the past year, new methods and technologies have been developed aimed at improving and streamlining the activities of female and male soldiers on the battlefield.
As part of this, reconnaissance and attack drones have been used and modern technological trainers have been placed at training bases.
The IDF is also working to establish another engineering battalion to join the three engineering battalions that currently exist within the armored brigades.
Last week, the November 2024 recruitment cycle for ground units began. This is the fourth recruitment cycle since the start of the war. The training and exercise tracks of soldiers and reservists have been adapted to the reality of war and ongoing combat.

Report: Female Soldiers Oct 7 Warnings Met With Silence, Left to Face Hamas Unarmed
December 6, 2024 Jewish Breaking News – They watched. They warned. And when Hamas attacked, they couldn’t fight back.
The female observers at Nahal Oz had spent months reporting suspicious activity along the Gaza border, their alerts growing increasingly urgent as they spotted signs of Hamas preparing for what would become the October 7 massacre.
According to Maariv, these female observation soldiers, known in Hebrew as tatzpitaniyot, had been raising alarms about suspicious border activity as early as May 2023. Through their surveillance equipment, they documented a massive, day-long Hamas military exercise that would later prove to be a rehearsal for October 7. Their reports continued through the summer months, detailing Hamas terrorists gathering in concerning numbers less than half a mile from the border fence.
Sadly, their warnings were not heeded by the upper echelons in the Israel Defense Forces.
When Hamas breached the Gaza border fence that fateful morning, the female observers had no weapons to defend themselves. At Nahal Oz alone, fifteen women from the 414th observation unit lost their lives. Overall, the assault claimed 45 more soldiers at the outpost, including nearly twenty from the reconnaissance unit, part of a devastating toll that would reach 331 IDF personnel and 61 police officers along the Gaza border.
Now the IDF is racing to correct this deadly oversight. A new directive, set to take effect within six weeks, will arm every female observer with a Tavor-type rifle upon completion of their training. The military is also modernizing its battlefield capabilities, deploying advanced reconnaissance drones and upgrading training facilities.
It’s a change the fallen heroes at Nahal Oz never got the chance to see.

LET THEM KILL EACH OTHER: Syria Fighting Benefits Israel if Both Sides Are Weakened
December 5, 2024 The Yeshiva World – An Israeli official has stated that the country views the resurgence of conflict in Syria as an opportunity for mutual weakening between the opposing factions. Speaking to The Times of Israel, the official commented on recent rebel advances against the regime of Bashar al-Assad.
“Our interest in the renewed fighting is that they continue fighting one another,” the official said. “It’s entirely clear to us that one side consists of Salafi jihadists, and the other includes Iran and Hezbollah. We want them to weaken one another.”
The official emphasized that Israel is not intervening in the conflict but remains vigilant. “We are prepared for any scenario, and we will act accordingly,” they added.
Report: Hamas gives instructions to ‘neutralize’ the hostages
Terror group’s leaders instruct those holding hostages captive in Gaza to ‘tighten’ living conditions of the captives and ‘neutralize’ them if rescue appears close at hand.
Dec 4, 2024, 7:55 PM (GMT+2) Israel National News – Hamas leaders have ordered the organization’s operatives to “neutralize the hostages” if Israel launches a rescue operation to free the hostages, Reuters reported on Wednesday,
The report cites an “internal document” in which Hamas leaders ordered operatives holding the Israeli hostages to “neutralize them,” after Hamas leaders claimed that “information has been received that Israel is planning an operation to rescue the hostages.”
The document also tells operatives to “not consider the possible consequences of carrying out the instructions” and places responsibility for the fate of the hostages on Israel.
The document does not specify when the Israeli rescue operation is scheduled to take place or whether Israel has information about the location of the hostages, but it does state that “Israel is planning a rescue operation similar to the one it conducted in June in the Nuseirat camp.” In the rescue operation in question, four Israeli hostages were rescued from Hamas captivity.
In the internal document dated November 22, under the heading “Recommendations,” Hamas leaders instruct operatives to “tighten the living conditions of the hostages” and “activate neutralization orders … as an immediate and swift response to any adventure by the enemy.” However, they do not specify in the document what the word “neutralize” means and whether the intention is to kill the hostages.
101 hostages remain in captivity in Gaza more than a year after they were kidnapped during the October 7 massacre.

MKs Submit Bill Allowing Criminal Probes Against AG, State-Attorney
December 3, 2024 Yeshiva World News – Religious Zionist MKs Tzvi Sukkot and Simcha Rothman on Tuesday submitted an amendment to the Knesset’s secretariat that would allow criminal investigations against the Attorney General and the State Attorney.
The report comes on the same day that Communications Minister Shlomo Karhi published a list of ministers who signed a letter he wrote demanding that Attorney-General Gali Baharav-Miara be ousted from her position for “systematically opposing the government and its ministers.” The letter is signed by Likud members Karhi, May Golan, Amichai Chikli, David Amsalem, Chaim Katz, Miki Zohar and Idit Silman; UTJ members Meir Porush and Yitzchak Goldknopf; and Otzma Yehudit members Itamar Ben-Gvir, Amichai Eliyahu, Orit Strook, and Yitzchak Wasserlauf.
According to the amendment, in the event that the police learn of an offense committed by the Attorney General or the State Attorney or anyone on their behalf, they will refer the matter to the Justice Minister to appoint a prosecutor who will have all the powers of the Attorney General and the State Attorney regarding investigation and prosecution.
“The Attorney General and the State Attorney head the law enforcement and prosecution system in Israel,” Sukkot and Rothman explained. “Although there are several provisions regarding opening investigations and filing indictments against senior officials such as the Prime Minister, ministers, judges, and more, there is a deficiency concerning initiating such a process against the Attorney General and the State Attorney.”
“In a situation where there is suspicion of an offense by the Attorney General or the State Attorney, a significant conflict of interest arises in the involvement of the prosecution in the aforementioned allegations, from accompanying the investigation to the decision of whether there is a basis to file an indictment.”
“In light of this,” they concluded, “the proposed law seeks to correct the situation and allow the Justice Minister to appoint an external prosecutor for the prosecution in these cases, similar to the investigation of police officers conducted by the Internal Affairs Unit and not by the police investigation bodies.
“Under the proposed law, the appointed prosecutor will be granted powers equivalent to those of the Attorney General and the State Attorney.”

The Police Internal Investigations Department investigated two senior police officers for unethical conduct and a senior Israel Prisons Service official for obstruction of justice and breach of trust. Ben-Gvir: ‘This is a coup.’
Dec 2, 2024, 11:14 AM (GMT+2) Israel National News – It was announced on Monday that two senior officers in the Israel Police Force and a senior official in the Israel Prisons Service (IPS) were investigated by the Police Internal Investigations Department.
An officer of the rank of Commander was investigated on suspicion of unethical behavior, while the other officer, a Superintendent, was investigated for similar offenses. The senior IPS official was investigated for charges of obstruction of justice and breach of trust.
According to the Internal Investigations Department announcement, the investigation is still underway, and as part of the process, a gag order has been issued for the details of the case.
A heated discussion took place this morning between Attorney General Gali Baharav-Miara and National Security Minister Itamar Ben-Gvir when she notified the minister of the investigation. Ben-Gvir responded: “I have a feeling that they’re persecuting anyone who implements my policies.”
Minister Ben-Gvir attacked the investigation: “This is a coup. The Attorney General and the State Prosecutor are using the Internal Investigations Department to discourage a very high-up IPS official and police officers from carrying out my policies and those of the right-wing government.”
Bereaved father files complaint against Moshe Ya’alon: Harm to state security Hezki Baruch
Attorney Itzik Bonzel, father of Staff Sergeant Amit Bonzel who fell in Gaza, files complaint with Israel Police against former Defense Minister who alleged that IDF soldiers are committing “ethnic cleansing” in Gaza.
Dec 2, 2024, 4:43 AM (GMT+2) Israel National News – Attorney Itzik Bonzel, father of Staff Sergeant Amit Bonzel who fell in battle in the Gaza Strip, on Sunday filed a complaint with the Israel Police against former IDF Chief of Staff and Defense Minister Moshe Ya’alon.
The complaint was filed in response to Ya’alon’s statements alleging that IDF soldiers are committing “ethnic cleansing” in Gaza, effectively accusing them of genocide.
Ya’alon made the initial claim in an interview with Democrat TV and reiterated this claim in interviews he gave on Sunday morning. Despite attempts by the interviewers to challenge his stance and steer him away from these harsh accusations against IDF soldiers, Ya’alon did not retract his statements.
Bonzel responded by saying, “Ya’alon’s hatred for Netanyahu has driven him mad, but that’s his problem. Our problem is that his words amount to incitement and harm to state security.”
He stressed that Arab television networks have already used Ya’alon’s statements to attack Israel, presenting his remarks as “proof” of genocide by the IDF in Gaza.
“Ya’alon’s statements endanger our heroic soldiers, constitute incitement against the state, and directly harm national security,” said the bereaved father.
He further noted that in recent times, investigations and arrests have been carried out against right-wing activists, and he expects the police and the Israel Security Agency (Shin Bet) to prove to the public that enforcement is not selective.
“I expect the Israel Police and the Shin Bet to show the people of Israel that there is no intention to target only right-wing activists, but also to arrest and interrogate individuals like Ya’alon, [Ehud] Barak, and others,” Bonzel said. “Ultimately, an indictment should be filed against Ya’alon for incitement and harming state security. This is an opportunity for the police to prove that enforcement is not selective.”
Bonzel concluded by calling on the Israel Police to immediately summon Ya’alon for questioning and to keep him in custody until the end of legal proceedings. “We will no longer sit idly by and allow people like him to trample on the honor of our heroic IDF soldiers,” he stressed.

In an interview, Ya’alon reiterated his claim that “Israel is committing ethnic cleansing in Gaza.” He argued that Israeli soldiers are in a precarious situation that could lead to international legal action.
Reaction from political figures was swift, with criticism from Likud MK Amit Halevi and National Security Minister Itamar Ben-Gvir, who defended the IDF’s operations as humanitarian and just.

Dec 1, 2024, 3:11 PM (GMT+2) Israel National News – Attorney Nitsana Darshan-Leitner, President of the ‘Shurat HaDin’ lawfare organization, told Arutz Sheva – Israel National News about the significant implications of a statement made by a former Israeli Chief of Staff and Defense Minister categorizing IDF actions as ethnic cleansing. She highlights a genuine threat not only to Netanyahu and Gallant but to all IDF soldiers and the state of Israel.
”This is dramatic and dangerous for IDF soldiers and the state of Israel. The statement that the IDF conducts ethnic cleansing in Gaza implies that the IDF is committing war crimes there,” explains Darshan-Leitner, noting that ”The IDF faces trials at the International Criminal Court and the International Court of Justice, both in The Hague, both pursuing the state of Israel and the IDF for alleged genocide, war crimes, and crimes against humanity in Gaza.”
According to Darshan-Leitner, the IDF is close to facing judgment, although no concrete trial has commenced yet. Such a trial would start either by handing over Netanyahu and Gallant to the court or if a decision is made to hold a trial in their absence. ‘’The International Court of Justice hasn’t entered the process yet but has begun discussions, issuing warrants, though not delving into the matter fully.’’
”What these courts need to demonstrate IDF war crimes is evidence of intent. Until now, they’ve relied on populist statements from public figures, artists, politicians, and media personalities talking about flattening Gaza or withholding humanitarian aid, but now we have a former Chief of Defense making these claims more than a year later. It couldn’t be a clearer signal against Gallant, Netanyahu, and the IDF,” she elaborates, emphasizing this wasn’t an offhand comment but rather a deliberate statement from a credible authority, repeated later on.
Darshan-Leitner further asserts, ‘’Ethnic cleansing is a part of genocide, conducted through expulsion or more violent methods like genocide, mass displacement, and starvation. This claim is perilous.’’
Attorney Darshan-Leitner underlines the overarching threat to every officer and soldier, explaining that ”The court won’t limit its warrants to Netanyahu and Gallant. It’ll pursue the Chief of Staff, commanders, and soldiers. This is just the start of their probe and it’s uncertain what warrants they have in store. This endangers IDF soldiers and the state as a whole. For instance, 600 artists recently urged a London museum to sever ties with Israeli artists because of alleged war crimes committed by Israel. Such demands seem daunting now that a former Defense Chief and Chief of Staff explicitly claims that Israel perpetrates war crimes and ethnic cleansing, logically inviting boycotts against Israel.” She notes similar impacts on the Israeli academic, industrial, and military sectors.
Regarding the international reaction to the event, she stated, ‘’They’re capitalizing on this. Newspapers in the USA have yet to engage, while Arab media celebrates during our hours, Europe wakes up, and the USA follows. It’ll be a spectacle. It’s more than just fueling fires.”
Darshan-Leitner raises the legislation her organization advocates for, inspired by the US American Service-Members’ Protection Act, granting the President authority to send troops to The Hague, seize control, and rescue personnel. This law also prohibits any American entity and many allies from cooperating with the court.
The law Shurat Hadin is attempting to introduce bars any Israeli citizen or organization from collaborating with The Hague court. If enacted, Yaalon would be unable to testify before the court when requested as part of its effort to gather forensic evidence against Israel.
At present, such legislation faces delays from unspecified political sources in Israel.
In response to what can be done against such phenomena without the law, Darshan-Leitner questions which category Yaalon’s words might fall into to prevent them. Asked whether aiding the enemy during war could be considered such, she responds, ‘‘Perhaps. We’re discussing it openly, but that’s the direction.”

Investigation records indicate Rabbi Kogan made two stops that morning – his usual visit to Dubai’s Rimon kosher supermarket, where he worked as part of his duties with Chabad, followed by a scheduled dental appointment. The Israeli-Moldovan rabbi, who had spent four years building Jewish life in the Emirates, never reached that appointment.
Text messages recovered from Rabbi Kogan’s phone show his last communication was a casual exchange with friend Chaim Heber, sending the Hebrew word “sababa” – meaning “cool” – about weekend plans.
Emirati authorities have pieced together that kidnappers intercepted Rabbi Kogan during his journey, attempting to transport him toward the Omani border. While the exact circumstances remain sealed as part of the ongoing investigation, officials have confirmed to the Washington Post that Rabbi Kogan’s body and vehicle were found within UAE territory near the border crossing.
The breakthrough in the case came with the arrest of three Uzbek nationals who initially escaped to Turkey before being returned to UAE custody. Their capture has opened new lines of inquiry into whether the attack was premeditated and potentially coordinated with others.

November 30, 2024 – The Hamas terror group on Saturday released a propaganda video showing signs of life from hostage Edan Alexander, 20, in the first video of its kind in months.
Alexander’s family permitted the video to be published in Israeli media.
The three-and-a-half-minute-long video is not dated, though Alexander states that he has been held for over 420 days. If true, it would have been filmed this week.
Alexander, a US citizen, is a soldier who was stationed near the Gaza Strip on the morning of October 7 when he was taken captive by Hamas, along with 250 other hostages. Hamas also killed over 1,200 people, mostly civilians, during that attack, which sparked the ongoing war that the Israeli military is fighting against Hamas in Gaza.
Alexander was born in Tel Aviv, grew up in Tenafly, New Jersey, and joined Golani as a lone soldier after graduating from high school in 2022.

According to the publication, the proposal discusses the gradual withdrawal of the IDF from Gaza and the establishment of an international committee headed by the United States to oversee the ceasefire. A Hamas delegation is to arrive in Cairo to discuss.
.. Egypt and Israel are in talks to reopen the Rafah crossing to Gaza. The Wall Street Journal reports that this is a new move that may allow more aid to enter the Strip and advance a broader deal.
