Few people are troubled by the fact that the scroll in which the establishment of the State of Israel was declared calls for the establishment of an “elected constituent assembly,” to be convened no later than October 1, 1948, to adopt a constitution for the fledgling state.

In 1949, the provisional government of Israel arranged for the election of a “constituent assembly” to write the state’s constitution and prepare for the elections to the Israeli Knesset. The assembly was duly elected and appointed a constitution committee composed of representatives of various factions, most of whom were socialists.
A draft constitution was submitted to the committee. The draft stated that the President must be a Jew—a logical conclusion, given that the scroll repeatedly emphasized that Israel is a “Jewish” state. The representatives of the socialist parties opposed this logic: they feared that Israel would be perceived by the world as “racist.”
The representatives of the religious parties regarded these fears as faintheartedness, but the secularists, who were the majority on the committee, outvoted them. Subsequently, the provisional government declared itself the “Knesset,” and the inhabitants of Israel have thus lived under a system of government that was never formally approved. This system has become increasingly dysfunctional and corrupt.
The constitution remained an urgent need. Although the religious parties now say, “We have a constitution, the Torah,” the truth is that they fear (and rightly so) a leftist constitution, on the one hand, and are driven by sectoral interests, on the other. Besides, Israel currently lacks the intellectual and moral qualities of a Torah government, which prescribes a king and a Sanhedrin, requiring—according to Jewish law—the approval of the people, something that cannot be immediately expected. Therefore, a more limited constitution is needed, one that is suitable for Israel’s “mixed” population.
Although no constitution—not even the Torah (which depends on human commitment to uphold) —can guarantee a decent and effective government, a well-drafted constitution can facilitate the possibility of such a government. It can thus facilitate a resolute, comprehensive, and consistent national policy, thereby contributing to national unity and security, as well as to national pride and economic prosperity.
Any reasonable, unbiased Jew, whether “religious” or not, can support such a constitution, provided they are reasonably sure that it will help remedy the glaring deficiencies in Israel’s current system of government and protect their individual and civil rights. There is no doubt that they would prefer to vote for a specific candidate who is known to them and accountable to them, instead of voting for a vague, self-perpetuating oligarchy, that is, for any party list that grants politicians safe seats and allows them to ignore public opinion and escape punishment. Who can be satisfied with a parliamentary system that sprouts political parties like weeds, parts of government prone to corruption that tarnish Israel, and undermine Jewish national identity and its goals?
If Israel wishes to preserve its Jewish identity, then the non-Jewish inhabitants loyal to Israel, although they will enjoy a full range of human, civil, economic, and religious rights, cannot logically be granted the authority to decide what the nation’s laws and policies will be; this does not mean they cannot participate with Jews in a branch of government that ensures their rights, while at the same time promoting justice and national loyalty. Israel therefore needs a four-branch system of government in which only Jews will be eligible to vote and be members of the legislative, executive, and judicial branches, while the fourth branch will be open to both Jews and non-Jews.
We therefore propose a unique, bicameral parliament. Since the legislature has two main functions—lawmaking and administrative oversight—we propose the following: the function of lawmaking will be assigned to the “Senate,” while the function of administrative oversight—which is lacking in the Knesset today because it is subordinate to the government—will be assigned to the “House of Representatives.”
We present here a basic outline of the constitution, to explain its general character:
Preamble
We, the people of Israel, grateful to the Creator Who has preserved us as a nation and returned us to the land of our fathers, do solemnly enact this Constitution. Nothing in this Constitution shall be construed as detracting from the authority of the Torah, or from the wisdom of our prophets and sages. On the contrary, this Constitution is intended to preserve the Jewish heritage, and to hasten the day when Israel will serve as an example where liberty coexists with justice, equality and excellence, wealth and beauty, and at the same time with the love of the eternal Creator.
A. Institutions of Government
The Senate
- The laws of the nation shall be enacted in the Senate, and all treaties or agreements with foreign powers or entities require the approval of three-fifths of the full Senate.
- The Senate shall be composed of 120 members, 80 of whom shall be elected personally in regional elections.
- The Senate shall serve for six years, with one-third of its members being elected every second year.
- To be eligible for election to the Senate, a person must be knowledgeable in the Hebrew Bible, Jewish history, and its customs, and this knowledge must be certified by secular and/or religious educational institutions, as shall be determined by law.
- Any group of 20 or more senators may nominate a candidate for the presidency (and for vice president). The number of candidates nominated shall not be less than two, and not more than three.
- A majority of the members of the Senate may, in a petition submitted to the President, request that the President refuse to sign and publish as law any bill (except those affecting security and property expropriation), on the grounds that it includes a clause of national importance, such that the will of the people regarding it should be ascertained by a national referendum.
The House of Representatives
- The House of Representatives shall be composed of 80 members personally elected in regional elections, in accordance with the Senate elections. The elected members shall serve for four years, with half being elected every second year, along with the Senate elections.
- Excluding classified security matters, the House of Representatives shall examine the national administrative authorities, including government ministries, the army, and any institution or enterprise in which a national authority participates, whether in management or financially. The review shall include accounting, legality, and the appropriateness of the methods examined.
- The House of Representatives shall conduct public hearings, investigate public complaints regarding the administration, and propose measures to correct any deficiency or misuse of administrative means.
- The House of Representatives may recommend legislative acts to the Senate, which the Senate may reject or amend as it sees fit. However, if such recommendations are enacted into law, their legal validity will derive solely from the actions of the Senate.
The President
- The executive authority shall be vested in the President. To ensure the services of a wise and experienced president, he may be re-elected for two consecutive terms after his first election to the presidency.
- The names of the presidential candidates (and their respective vice-presidential candidates) shall be put to a national secret ballot. The candidate who receives a majority of the votes shall be elected President. If no candidate receives a majority, the two who received the highest number of votes will compete in a run-off election.
- The President shall recommend legislation to the Senate. He shall appoint, with the advice and consent of the Senate, the government ministers, shall have the authority to sign treaties, be the Commander-in-Chief of the Israel Defense Forces, and be responsible for the administration of the laws.
- The President shall have a suspensive veto power over laws passed by the Senate, but such a veto may be overridden by three-fifths of the full Senate.
- The President, with the advice of a council knowledgeable in Israeli law and secular law, shall appoint the justices of the Supreme Court. The names shall be submitted to the Senate for confirmation, by a majority of one more than the full plenum.
- The President shall be subject to impeachment for improper conduct by three-fifths of the full Senate, presided over by the Chief Justice of the Supreme Court.
The Judiciary
- The judicial powers shall be vested in a Supreme Court of nine members, and in such lower courts as the Senate may from time to time establish.
- Among the various systems of law practiced in Israel, Jewish law shall be first in any case where an Israeli statute is ambiguous or unclear, as when an Israeli law explicitly differs from Jewish law. (This is consistent with the Foundations of Law Act of 1980, which states: “Where the court sees a legal question requiring a decision, and does not find an answer in statute, case law, or by way of analogy, it shall decide it in light of the principles of freedom, justice, equity, and peace of Israel’s heritage.” The term “heritage” should be interpreted as including Jewish law).
- No law enacted by the Senate despite a presidential veto shall be subject to judicial review.
- No law approved by a national secret ballot shall be subject to judicial review.
- No law enacted by the Senate and signed by the President may be annulled by less than two-thirds of the full members of the Supreme Court.
- Questions of personal status (such as marriage, divorce, and conversion), shall be decided exclusively by rabbinical courts.
- The justices of the Court shall be subject to impeachment for improper conduct by three-fifths of the full Senate.
B. Amendments
- Amendments to the Constitution shall require the approval of two-thirds of the full Senate, and thereafter by a secret ballot of those eligible to vote for members of the Senate.
C. Additional Constitutional Provisions
- This Constitution affirms, as its paramount principle, the Jewish character of the nation, to which all other principles are subordinate. Any party that opposes this paramount principle shall be excluded from any national or local elections.
- All elected officials and public servants shall pledge their allegiance to Israel as a Jewish nation.
- No person holding office under this Constitution shall be entitled during his term of office to hold any other public office.
D. Constitutional Bill of Rights
- The Land of Israel, of which the government is the sole trustee, belongs exclusively and forever to the Jewish people, and no part of this land shall be transferred to non-Jews.
- Except for public purposes to be defined by law, the government shall encourage private Jewish ownership and development of the Land of Israel.
- No Jewish Israeli citizen or resident living abroad shall be denied the right to vote in elections in which he is eligible to vote.
- All residents of Israel shall be guaranteed freedom of religion and freedom of speech and the press.
- All residents of Israel shall have the right to establish their own religious and educational institutions, provided they are consistent with loyalty to the Israeli nation.
- The right of workers to strike shall not be abridged, except for those connected with public services, which shall be resolved by arbitration.
- No resident of Israel shall be compelled—in any criminal case—to be a witness against himself, nor be deprived of life, liberty, or due process of law.
- In all criminal prosecutions, the accused shall have the right to be represented by counsel, to a speedy and public trial, to be informed of the nature of the accusation; to be confronted with the witnesses against him, to have compulsory process for obtaining witnesses in his favor, and to have the assistance of counsel for his defense.
- The right of all residents of Israel to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated.
- The enumeration in this Constitution of certain rights shall not be construed to deny or disparage other rights retained by the Jewish people, or that were affirmed in the Torah in connection with Jews and non-Jews.
Conclusions
The foregoing constitutional provisions are provisional and incomplete. The manner of establishing the various branches of government requires further elaboration, as do their respective powers and procedures.
Nevertheless, this proposed constitution: (a) will strengthen Israel’s dignity; (b) will facilitate the wise formulation and execution of national policies; (c) will elevate the moral and intellectual character of Israeli politics; (d) will enable the government to negotiate more purposefully with foreign powers, and (e) will promote Jewish unity and national pride.

A comprehensive investigation has uncovered systematic sexual violence perpetrated by Hamas terrorists during the onslaught on Israel.

Fresh testimony from survivors and witnesses demonstrates that Hamas terrorists systematically employed sexual violence during their Oct. 7, 2023, assault on Israel, according to a comprehensive investigation that documents previously unreported accounts of rape and sexual abuse.
The upcoming Dinah Project report presents evidence from 15 returned hostages who experienced sexual violence in captivity, with only one having spoken publicly before now, the U.K. newspaper The Sunday Times revealed.
The investigation, conducted by Israeli gender and legal experts with partial funding from the British government, found that sexual violence was “widespread and systematic” during the onslaught that killed approximately 1,200 people.
According to the Sunday Times, the report establishes that rape and gang rape occurred in at least six locations, though most victims were “permanently silenced”—either murdered during the assaults or left too traumatized to speak.
The Dinah Project will be published on Tuesday in Jerusalem, representing the most comprehensive documentation of sexual violence during the Oct. 7 attack, the newspaper reported.
The report draws from first-hand testimony of 15 returned Gaza hostages, a survivor of attempted rape at the Supernova music festival and interviews with 17 people who witnessed or heard the attacks, along with therapists treating traumatized survivors.
The project aims “to counter denial, misinformation and global silence” regarding what researchers describe as “one of the most under-reported dimensions of the attacks.”
The report states its mission is “to set the historical record straight: Hamas used sexual violence as a tactical weapon of war.
“Clear patterns emerged in how the sexual violence was perpetrated,” the report documents, “including victims found partially or fully naked with their hands tied, often to trees or poles; evidence of gang rapes followed by execution; and genital mutilation.”
The documented attacks occurred at the Supernova music festival, Route 232, the Nahal Oz military base, and three kibbutzim: Re’im, Nir Oz and Kfar Aza. Sexual abuse extended beyond the initial assault locations, the report reveals.
“Sexual violence continued in captivity, with many returnees reporting forced nudity, physical and verbal sexual harassment, sexual assaults and threats of forced marriage,” the investigation adds.
Examples from Islamic State and Boko Haram
Professor Ruth Halperin-Kaddari, director of the Ruth and Emanuel Rackman Center for the Advancement of the Status of Women at Bar-Ilan University in Ramat Gan, initiated the project to “ensure recognition and justice for victims and survivors.”
She collaborated with Sharon Zagagi-Pinhas, an international law expert and former IDF chief military prosecutor, and Nava Ben-Or, a retired judge and former deputy state attorney specializing in sexual abuse cases.
The research addresses criticism of inadequate responses from international organizations such as UN Women (full name the United Nations Entity for Gender Equality and the Empowerment of Women) following reports of sexual violence by the Sunday Times and other outlets.
The project also deals with questions raised by false claims from first responders and arguments that Hamas, as an Islamic organization, would not commit rape—despite examples from Islamic State (ISIS) in the Middle East and Boko Haram in West Africa.
Some critics argued that the sexual violence issue had been “weaponized” by the Israeli government to justify its actions in Gaza.
This criticism particularly affected Halperin-Kaddari, who had worked for years on international cases of sexual violence, including Yazidis taken as sex slaves by ISIS and girls abducted by Boko Haram in Nigeria.
“We feel let down by other women around the world,” Halperin-Kaddari said. “If the standard is to believe survivors and witnesses, there is no excuse to keep quiet.
“Yet in this case, a different standard was employed and the victims were lost in politicization. The fact that so many kept silent or even denied what happened was devastating and a grave failure of international human rights.”
The project takes its name from the first rape victim in the Bible—Dinah, Jacob’s only daughter, who was raped by Shechem, son of a prince.
After the assault, Dinah’s brothers circumcised and killed the men of Shechem’s tribe and abducted their women, but Dinah’s voice was never heard.
Halperin-Kaddari explained that the project aims “to be a voice for those who cannot or can no longer speak.”
Previous fact-finding reports by the U.N. special representative for preventing sexual violence, a U.N. independent commission of inquiry and the International Criminal Court all found indications of sexual violence and gang rape.
However, the Dinah Project introduces new evidence, including first-hand witness testimony from 15 returned hostages who experienced sexual violence in captivity.
Among the hostages, only one has spoken publicly: Amit Soussana, a lawyer held for 55 days.
Two of the hostages were male, according to the report.
Zagagi-Pinhas explained that “sexual violence need not mean rape—also forced nudity, forcing some of the hostages to strip and shower while being watched, or trying to force them into marriage.”
The researchers also interviewed a victim of attempted rape at the Supernova festival who required 17 months to come forward. “We know from therapists there are more, but they are still too traumatized to speak,” Zagagi-Pinhas added.
The investigation included interviews with 17 people who witnessed or heard attacks, providing detailed descriptions of the violence.
These witnesses included two brothers who hid under bushes, and Tali Biner, a nurse who concealed herself inside a shipping container. They described 15 incidents including gang rapes.
Additionally, researchers spoke with 27 first responders who described “dozens of cases in different locations” while analyzing forensic evidence from photographs and videos.
Justice when many of the victims are dead
“What we found makes clear that sexual violence including rape and gang rape took place in multiple locations,” Halperin-Kaddari said.
“We found patterns of evidence,” Zagagi-Pinhas added. “Women found dead, naked and mutilated—with gunshots in their genitalia–and tied to trees. The fact that the same things happened in three to six locations can’t be coincidence, but proof that this was premeditated.”
She reported that “dozens” of bodies of young women were stripped and some were tied to trees or poles. “Many of the witnesses we spoke to talk of the victims being shot and perpetrators still trying to rape a dead body,” she said.
The report’s primary objective is to demand justice, providing what Halperin-Kaddari describes as “a blueprint for how to secure justice in cases of mass atrocities when many of the victims are dead and it is impossible to point at a specific perpetrator.”
“We see October 7 as a test case,” said Ben-Or, the retired judge. “Authorities are used to seeking justice on an individual case, but here we have mass cases and most victims were murdered or too traumatized to speak, which creates profound challenges for establishing accountability, so we needed to come up with a new legal framework and new ways to prosecute.
“Sexual violence in conflict is about destruction and dehumanizing a community, so the idea you have to find a specific perpetrator who harmed a specific victim is irrelevant,” she added.
“To say, ‘When I joined Hamas, I meant only to murder women and children, but I am very much against rape’ is ridiculous. Everything that was done within the framework of the attack, you are responsible for.”
The report calls for the U.N. secretary-general to send a fact-finding mission in light of the testimonies and to include Hamas in the blacklist in the U.N.’s annual report of those designated for using sexual violence as a weapon of war.

Government responds to court on petitions against AG’s dismissal
Government argues it is unreasonable to force it to continue working with a legal official who is politically motivated and has long since lost its full confidence in it.

The Israeli government on Sunday morning submitted its official response to the Supreme Court regarding petitions against the ongoing proceedings to dismiss Attorney General Gali Baharav-Miara.
In a sharply worded statement, Justice Minister Yariv Levin and Minister Amichai Chikli, who chairs the ministerial committee on replacing the Attorney General, accused Baharav-Miara of creating an “absurd situation” in which she allegedly “uses state resources for her personal needs and subjugates the public legal service to her personal will.”
“For a long time now, the Government of Israel has not received a fair legal process in cases involving disputes with its legal advisor,” the response stated. “The government sees no point in continuing this charade and expects the Supreme Court to recognize the magnitude of the absurdity, distortion of justice, and flawed legal proceedings. The Attorney General has systematically acted to sever the rope—and has indeed torn it. Now she expects the Honorable Court to do the same, despite the grave implications. This must and should be avoided.”
The government contends that Baharav-Miara is in a clear conflict of interest, as she is directly implicated in the petitions yet allegedly denies the government legal representation while instructing state attorneys to present only her personal stance. “This is an upside-down reality,” the government wrote. “The public legal service is not the personal property of the Attorney General. It is meant to represent the government. Expecting the government to respond to petitions while detached from its legal team undermines its right to a fair process.”
The government further accused Baharav-Miara of applying a double standard: “She demands that the government avoid distant and speculative conflicts of interest, while she herself stands before the court with a glaring conflict of interest of her own.”
The response argues that the very conduct of the legal proceedings at the Supreme Court, in the absence of proper legal representation for the government, highlights the severity of the current crisis. It emphasized that the process undertaken against Baharav-Miara was lawful and that her hearing was conducted with full respect for her rights.
The government also noted that Baharav-Miara failed to respond for months to official documents presented to her and did not attend the cabinet meeting where allegations against her were discussed. Nevertheless, it stressed that the decision to grant her a hearing went “far beyond what is required.”
The statement concluded with a submission of two supplementary documents detailing the grounds for her dismissal, including records of repeated attempts to bridge differences with Baharav-Miara—attempts the government claims failed and now cause “severe damage to the governance of the country and to the public at large.”
The government called on the court to reject the petitions and interim orders “outright,” arguing it is unreasonable to force it to continue working with a legal official it claims is politically motivated and has long since lost its full confidence.
